Which court do I go to?

You must go to the correct court for your legal matter. This is called the . The proper venue may change depending on the legal matter before the court. 

Criminal matters

A charge and , or notice to appear will detail the court venue and date for a court appearance. 

In criminal matters, the proper venue is the court closest to:

  • where the offence is alleged to have been committed; or 
  • where the lives. 

Civil matters

The is required to file a civil matter at the proper venue. Consideration should be given to where the:

  • lives
  • defendant conducts their business - if the civil matter is related to the business
  • the dispute or issue occurred
  • contract was executed or carried out. 

In civil matters, the proper venue is the court closest to: 

  • the place where the subject-matter of the complaint started; or
  • where the defendant lives.

Intervention orders
An interim order can be made at any Magistrates’ Court venue. Once an interim order application has been decided, the matter may be transferred to the proper venue for the next hearing.
