Applying for an infringement extension

Find out if you are eligible to make an infringement extension application.

Important changes to infringement extension applications:
Traffic or tolling offences

Commencing 8 March 2024, infringement extension applications for traffic related offences (except excessive speed and drink or drug-driving offences) and tolling offences (CityLink and EastLink) will no longer be determined at the Magistrates’ Court.
These applications will be managed by Fines Victoria and must be submitted by visiting the Fines Victoria website.

Excessive speed, drink-driving/drug-driving and excessive drink or drug operation of a sea vessel offences

The Magistrates’ Court will continue to determine infringement extension applications relating to excessive speed, drink-driving/drug-driving and drink or drug operation of a sea vessel offences. Please read below and complete the eligibility guide to find out if you are eligible to make an application to the Magistrates’ Court.

If you have been advised by Fines Victoria to make an application to the Magistrates’ Court in relation to an:

  • excessive speed infringement (a speed of 130 km/h or more regardless of speed limit - or - 25km/h or more in excess of the speed limit)
  • drink-driving/drug-driving infringement
  • excessive drink or drug operation of a sea vessel infringement

you may attend your local Magistrates' Court to apply for an infringement extension application. You can only apply for an infringement extension within 14 days of first becoming aware of the infringement.

If a magistrate grants your application, you may be able to:

  • object to the infringement notice – your infringement notice will be cancelled, and you will be served with a charge and to appear in court.
  • nominate the responsible driver at the time of the offence (excessive speed infringement only) – you will be provided with an additional 28 days to submit a nomination statement to Victoria Police.

You will need to know your infringement details including your offence type.

If you are applying in relation to more than one infringement offence, and you became aware of the infringements on different dates, you will need to run through the questions in the eligibility guide for each offence. You may be required to complete multiple application forms.
